    Privacy information for users

    Tikato S.r.l. with registered office in Vicenza, Piazzale del Mutilato n. 3/4 – 36100, VAT number 03836750244 and company registration number VI 358223 (hereinafter, the “Owner”), owner of https://www.discoup.com/uk/ (the “Site”), in its capacity as data controller of the personal data of the Site users (the “Users”) provides the below privacy policy (the “Privacy Policy") pursuant to art. 13 of EU Regulation no. 2016/679 of 27 April 2016 (the "Regulation" and/or the "Applicable Law").

    This Site and any services offered through this Site are reserved for persons of at least 18 years of age. The Data Controller does not collect personal data pertaining to persons under the age of 18. Upon receiving a request by a User, the Data Controller will promptly delete any and all involuntarily collected personal data that relates to persons under the age of 18.

    The Data Controller takes the utmost account of Users’ right to privacy and to the protection of their personal data. For any information relating to this privacy policy, Users may contact the Owner at any time, via one or both of the following methods:

    1. By sending a registered letter with return receipt to the Data Controller's registered office: Piazzale del Mutilato n. 3/4 – 36100 Vicenza
    2. By sending an e-mail message to INFO@DISCOUP.COM

    The Data Controller has not identified the figure of the Data Protection Officer (DPO) as the role is not subject to the designation obligation provided for by art. 37 of the Regulation.

    1. Purpose of the treatment

    Users' personal data will be processed lawfully by the Data Controller pursuant to art. 6 of the Regulation for the following processing purposes:

    1. contractual obligations and provision of the service; to allow navigation of the Site; or to implement those general conditions of the Site that are accepted by the User during registration and that fulfil specific User requests. The User's data collected by the Data Controller for these purposes may include: name and email address, as well as any personal User information that may be voluntarily published. Unless the User gives the Owner specific and optional consent to the processing of their data for the additional purposes set out in the following paragraphs, the User's personal data will be used by the Owner for the exclusive purpose of ascertaining the User's identity (also by validation of the e-mail address) to avoid possible scams or abuses, and to contact the User for service reasons only: for example, for sending notifications relating to the services offered on the Site as regards the Owner's products. Without prejudice to the provisions elsewhere in this Privacy Policy, in no case will the Data Controller make the Users' personal data accessible to other Users and/or third parties;
    2. administrative-accounting purposes, or to carry out activities of an organisational, administrative, financial and accounting nature, such as internal organisational activities and functional activities for the fulfilment of contractual and pre-contractual obligations; or
    3. legal obligations, or to fulfil obligations established by law, by an Authority, by a regulation or by applicable European legislation.

    Provision of personal data for the processing purposes indicated above is optional but failure to provide it will make it impossible for the User to navigate the site, register on the Site, or use the services offered by the Data Controller through the Site.

    Personal data that is necessary for the processing purposes described in this paragraph 1 is indicated with an asterisk in the registration form on the Site.

    2. Further processing purposes: marketing (sending of advertising material, direct sales, and commercial communication)

    Following the User’s freely and optionally-given consent, some of the User’s personal data - i.e. name, surname, e-mail address, telephone number, address - may be processed by the Data Controller for marketing purposes (including, for example, sending advertising material; direct sales; commercial communication; sending newsletters containing information on relevant news for the sector that relates to the Data Controller's activities), or so that the Data Controller can contact the User by e-mail, telephone (landline and/or mobile, with automated communication systems and/or without the intervention of an operator) and/or SMS and/or MMS in order to: provide the opportunity to purchase products offered by the Owner and/or by third-party companies; to present offers, promotions and commercial opportunities from the Owner and/or third-party companies.

    In the event of lack of consent, the processing purposes set out in paragraph 1 above will be unaffected.

    Where consent is given, it may be revoked at any time by making a request to the Data Controller in the manner indicated in paragraph 7 below.

    It is also possible to opt out from receiving further promotional communications via email by clicking on the appropriate link for the withdrawal of consent, which is included in every promotional email. Once consent has been revoked, the Data Controller shall send an e-mail message to confirm that consent has been revoked. A User who intends to revoke their consent to the receipt of promotional communications by telephone, while also continuing to receive promotional communications by email, or vice versa, should send a request to the Data Controller in the manner indicated in paragraph 7 below.

    Following the exercise of the right to object to the sending of promotional communications via email, technical and operational reasons (for example, the formation of contact lists already completed shortly before the Owner received an objection request) may mean that the User continues to receive further promotional messages. A User who receives promotional messages once 24 hours has elapsed from the exercise of the right to object should report the problem to the Owner, using the contacts indicated in paragraph 7 below.

    3. Additional processing purposes: profiling

    With the free and optional consent of the User, the Data Controller may also process the User's personal data (i.e. personal data and contact details, as well as information relating to services in which the User has expressed an interest) for profiling purposes, or to reconstruct the User's tastes and consumption habits in order to send the User commercial offers consistent with their commercial profile.

    If consent is not given, the User’s ability to register on the Site and use the services offered by the Owner will be unaffected.

    If consent is given, the User may revoke it at any time by making a request to the Data Controller in the manner indicated in paragraph 7 below.

    Processing methods and data storage times

    The Data Controller will process Users' personal data using manual and IT tools. It will do so using reasoning strictly related to the purposes themselves and in such a way as to guarantee the security and confidentiality of the data.

    The personal data of the Site's Users will be kept only for the length of time strictly necessary for the carrying out the primary purposes illustrated in paragraph 1 above (Purpose of the treatment), or according to what is necessary for the protection in civil law of the interests of both Users and Owner.

    In the cases referred to in paragraph 2 (Further processing purposes) and paragraph 3 (Additional processing purposes) above, Users' personal data will be kept only for the length of time strictly necessary for the carrying out of the purposes described within them and, in any case, for as long as the law permits further storage for such specific purposes, including for defense against legal requests.

    If the User decides to block and/or delete their profile, all stored data relating to that User will be deleted. If the complete deletion of a User’s data is not permitted or required by law, the data will be blocked for further processing.

    5. Scope of communication and dissemination of data

    The employees and/or collaborators of the Data Controller in charge of managing the Site may become aware of Users' personal data. These subjects, who are formally appointed by the Data Controller as "Data Processors", shall process a User's data exclusively for the purposes indicated in this Privacy Policy and in compliance with the provisions of the Applicable Regulations.

    The personal data of Users may also be disclosed to third parties who may process personal data on behalf of the Data Controller as "External Data Processors". These may include, for example: IT and logistics’ service providers functional to the operation of the Site; outsourcing or cloud computing service providers; professionals and consultants; and shippers and the like.

    Users have the right to obtain a list of any data processors appointed by the Data Controller, by making a request to the Data Controller in the manner indicated in paragraph 7 below.

    Registration via "Connect with Facebook"

    Users registered with Facebook may register on the Site via the "Connect with Facebook" service or equivalent, where this option is available on the Site. The data that may be communicated by Facebook to the Owner through the "Connect with Facebook" service is as follows: name; surname; profile picture; e-mail address via which the User can be contacted by Facebook (with 'actual' address or address on the proxymail.facebook.com domain); address; and date of birth. The Data Controller shall process such data exclusively for the purposes indicated in this privacy policy and in compliance with the consents given from time to time by the User. By subscribing to the "Connect with Facebook" service and clicking on the "Allow" button, the User agrees that the aforementioned data will be transferred to the Data Controller from the Facebook platform. The Owner will use this data to facilitate the registration procedure, pre-filling the fields of the User's registration form with the data communicated by Facebook. Users who use the Facebook Connect service will be able to access the Site using the log-in normally used to access Facebook.     7. Rights of interested parties

    Users shall be able to exercise the rights guaranteed to them by the Applicable Regulations by contacting the Owner in the following ways:

    2. By sending an e-mail message to INFO@DISCOUP.COM

    Pursuant to the Applicable Regulations, Users have the right to request access information concerning:

    (i) the origin of their personal data;

    (ii) the purposes and methods of processing;

    (iii) the logic applied to cases of processing carried out with the aid of electronic instruments;

    (iv) identification details of the owner and managers;

    (v) the subjects or categories of subjects to whom personal data may be communicated or who is permitted to learn about them in their capacity as managers or agents.

    Furthermore, Users have the right to obtain:

    a) access; updating; rectification or, where interested, integration of data;

    b) cancellation; or redaction or blocking of data processed unlawfully, including data whose retention is unnecessary for the purposes for which the data was collected or subsequently processed;

    c) attestation that the operations, and their content, referred to in a) and b) above have been brought to the attention of those to whom the data has been communicated or disseminated, except in cases in which fulfilment is impossible or involves the use of means manifestly disproportionate to the protected right.

    Furthermore, Users have:

    A) the right to withdraw consent at any time if the treatment is based on their consent;

    B) the right to data portability (right to the receipt, in a structured format commonly used and readable by an automatic device, of all personal data concerning them); the right to limit the processing of personal data; and the right to erasure ("right to be forgotten");

    C) the right to object:

    1. in whole or in part, for legitimate reasons, to the processing of personal data concerning them, even if pertinent to the purpose of the collection;
    2. in whole or in part, to the processing of personal data concerning that User for: the purpose of sending advertising material; direct sales; carrying out market research; or commercial communication;
    3. if personal data is processed for direct marketing purposes, at any time, to the processing of the data carried out for this purpose, including profiling to the extent that it is connected to such direct marketing;

    D) if they believe that the processing that concerns them violates the Regulation, the right to lodge a complaint with a Supervisory Authority (in the European Union Member State in which they usually reside; in the one in which they work; or in the one in which the alleged violation has occurred). The Italian Supervisory Authority is the Guarantor for the protection of personal data, with headquarters in Piazza Venezia n. 11, 00187 – Rome (http://www.garanteprivacy.it/).

    The Owner is not responsible for updating any of the links that can be viewed via this Privacy Policy. Accordingly, whenever a link is not functional or is not updated, Users acknowledge and accept that they must always refer to the document and/or relevant section of the websites referred to in the relevant link.
